Katrina Emergency Tax Relief Act of 2005 Gives Incentives for Charitible Giving
11/03/2005
Under recent legislation enacted in the aftermath of Hurricane Katrina, 2005 cash gifts to educational institutions and other charitable organizations are encouraged, as the Katrina Emergency Tax Relief Act suspends percentage limitations on gifts of cash made to charitable organizations for the remainder of the year, irregardless of whether or not the contributions are related to Hurricane Katrina.
Because of the temporary change in the law, donors may, in some cases, deduct cash gifts to qualifying charities up to one hundred percent of their adjusted gross income. Where a donor wants to make a meaningful gift or complete an outstanding pledge or commitment to a school campaign, a cash gift in 2005 may result in tax benefits not otherwise available.
Prior to the Act, cash gifts to colleges, schools, museums, and other public charities, were deductible up to 50% of the donor's contribution base. (One's contribution base is generally equal to adjusted gross income.) Thus, a donor who made a charitable gift to a public charity of $100,000, and who had a contribution base of $100,000, was allowed a deduction of no more than $50,000. Any excess contribution could be carried forward and used in subsequent years.
The Katrina Emergency Tax Relief Act temporarily suspends the percentage limitations on a cash gift to a college, school, museum or other qualified charities. In other words, the donor can obtain a charitable deduction for a gift of cash up to his or her entire adjusted gross income, reducing it to zero . In addition the 3% cut back on itemized deductions based on the donor's income in excess of $145,950 does not apply to qualifying cash gifts.
In order to take advantage of this tax-saving provision, the individual donor must meet the following requirements:
- First, the gift must be a cash gift paid between August 28, 2005 and December 31, 2005. Note that contributions of non-cash property, such as securities, will not qualify under the section.
- Second, the gift must be to a charitable organization described in section 170(b)(1)(A) of the Internal Revenue Code. This list includes, but is not limited to: most colleges and universities, schools, museums, and other publicly supported charities. Prestonwood Christian Academy is a charitable organization as defined by this section.
- Third, the individual must elect application of section 301 of the Act.
- Gifts to charitable remainder trusts or donor-advised funds do not qualify.
Provided the donor is able to comply with the above requirements, the Act provides an opportunity for considerable tax savings for the remainder of 2005 . Individuals may want to consider the implications of the new tax with their own tax advisors in connection with possible withdrawals from IRAs to fund outright cash gifts or the sale of appreciated stock and the gift of cash, rather than the gift of securities themselves. They may also want to accelerate their payments on pledges or other commitments.
It should be noted that the requirements for corporate donors are different than the requirements for individuals. Most notably, the applicable law for corporations requires that the contribution be made for relief efforts related to Hurricane Katrina, where there is no such requirement for individual donors.
Potential donors should think carefully before funding a charitable gift by means of a withdrawal from an IRA or the sale of securities with large unrealized capital gains. Both approaches increase one's adjusted gross income. The 3% cut back on itemized deductions still applies to itemized deductions other than that for the qualifying cash gift. Increasing one's income increases the value of the cut back and could eliminate those other deductions. In addition, some state income taxes offer no charitable deduction and, thus, no offset for the increased income.
For more information on making donations under the Katrina Emergency Tax Relief Act, visit the IRS website at www.irs.gov/newsroom/article/0,,id=149391,00.html or contact your tax advisor.

PCA Plans to Aid Hurricane Victims
09/01/2005
Prestonwood Christian Academy stands with the nation in expressing our sorrow in this time of terrible tragedy in the areas affected by Hurricane Katrina. In the storm, many lost their lives; thousands more lost their homes. Though hundreds of miles separate us from the physical damage and destruction, many in our PCA family have family, friends, or business associates i n the hardest hit areas. Our hearts and prayers are with each one.
Many of you, even those with no direct connection to the catastrophe, have expressed interest in relief efforts; some have asked how PCA can be involved in the process. Thank you for your concern and compassion, as your heart truly mirrors the heart of Christ.
PCA administrators are actively assessing the situation and determining the best course of action for our students and the extended PCA family. Rest assured, we will be involved; we will lend our support, both financially and through corporate prayer.
We will be communicating our plan to mobilize the PCA family within the coming days and weeks. In the meantime, please be in prayer for the thousands of lives affected by this storm. We serve a God whom, in spite of tragedy and natural disaster, is still in control. We rest on that truth in these days.
